Unfortunately, educators can face unexpected injuries while carrying out their duties.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In New York City, the Department of Education (DOE) provides support and compensation for <\/span><span style=\"font-weight: 400;\">teachers who sustain Line of Duty Injuries (LODI). However, the process of applying for LODI <\/span><span style=\"font-weight: 400;\">bene\ufb01ts can be confusing and frustrating, because administrators often hesitate to grant them. <\/span><span style=\"font-weight: 400;\">This article aims to shed light on the process of applying for and obtaining bene\ufb01ts for LODI <\/span><span style=\"font-weight: 400;\">as a NYC teacher.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Understanding Line of Duty Injuries (LODI):<\/b><\/p>\n<p><span style=\"font-weight: 400;\">LODI refer to work-related injuries or illnesses that occur while carrying out o\ufb03cial duties <\/span><span style=\"font-weight: 400;\">or as a direct result of these duties. Slipping and <\/span><span style=\"font-weight: 400;\">falling, injuries from violent students, vocal injuries, and repetitive stress injuries are all <\/span><span style=\"font-weight: 400;\">examples of possible LODI. When you are out of work on a LODI, you continue to receive <\/span><span style=\"font-weight: 400;\">full pay and bene\ufb01ts for the duration of your recovery period, with no time being taken out of <\/span><span style=\"font-weight: 400;\">your CAR balance.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Reporting the Incident:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The \ufb01rst step after sustaining a LODI is to promptly report the incident to your immediate <\/span><span style=\"font-weight: 400;\">supervisor or principal. It is crucial to provide a detailed account of the events leading to the <\/span><span style=\"font-weight: 400;\">injury and any available evidence, such as photographs or witness statements. Reporting the <\/span><span style=\"font-weight: 400;\">incident promptly ensures that the necessary paperwork can be initiated to begin the LODI <\/span><span style=\"font-weight: 400;\">claim process. There is a series of forms that need to be completed as soon as possible (within <\/span><span style=\"font-weight: 400;\">24 hours), which you can access with this link:<\/span><\/p>\n<p><a href=\"https:\/\/www.uft.org\/your-rights\/injured-on-job\/injury-line-duty\"><span style=\"font-weight: 400;\">https:\/\/www.uft.org\/your-rights\/injured-on-job\/injury-line-duty<\/span><\/a><\/p>\n<p><span style=\"font-weight: 400;\">You will also need to \ufb01ll out a Witness Statement form that should be provided to you by your School <\/span><span style=\"font-weight: 400;\">Safety Agent.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Seeking Medical Attention:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">After reporting the incident, seek immediate medical attention for your injury. Do not be afraid to <\/span><span style=\"font-weight: 400;\">call 911 or request an ambulance if you feel you need transport to the ER. If you do not feel an <\/span><span style=\"font-weight: 400;\">ambulance is required, inform your supervisor that you are leaving IMMEDIATELY, and head <\/span><span style=\"font-weight: 400;\">straight to your doctor, the ER, or Urgent Care. DO NOT make any stops in between leaving <\/span><span style=\"font-weight: 400;\">school and getting medical attention. This is critical for proving that the incident happened at <\/span><span style=\"font-weight: 400;\">school and any injuries were sustained as a result of that incident. Stopping along the way or <\/span><span style=\"font-weight: 400;\">going home \ufb01rst allows the DOE to possibly deny the LODI, stating that the injuries could have <\/span><span style=\"font-weight: 400;\">been sustained elsewhere after you left school. However, you choose to get medical care, be <\/span><span style=\"font-weight: 400;\">sure to inform the medical professional that the injury is work-related and provide them with the <\/span><span style=\"font-weight: 400;\">necessary details. Make sure you stress that the DOE self-insures LODI incidents and that they <\/span><span style=\"font-weight: 400;\">are not to go through Worker\u2019s Comp. You pay your copays and use your regular insurance and <\/span><span style=\"font-weight: 400;\">can be reimbursed for your expenses at the end of your treatment. Obtaining a comprehensive <\/span><span style=\"font-weight: 400;\">medical evaluation and documenting the extent of your injury is vital for your LODI claim.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Filing a LODI Claim:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">To initiate your LODI claim, you will need to complete the appropriate forms provided by <\/span><span style=\"font-weight: 400;\">the DOE. You may also want to write down <\/span><span style=\"font-weight: 400;\">everything you remember about the incident and the moments before, during, and after it <\/span><span style=\"font-weight: 400;\">happened. Do this while your memory is fresh so that as many names, places, sounds, etc, can <\/span><span style=\"font-weight: 400;\">be documented. You never know what tiny detail could become important.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Collaborating with Union Representatives:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">As a NYC teacher, you are a member of a Union, the UFT. Union Representatives can play a vital <\/span><span style=\"font-weight: 400;\">role in supporting you throughout the LODI claim process. They can provide guidance, <\/span><span style=\"font-weight: 400;\">ensure your rights are protected, and advocate on your behalf during any discussions or <\/span><span style=\"font-weight: 400;\">negotiations with the DOE. Contact your Chapter Leader or District Representative and call the Victim <\/span><span style=\"font-weight: 400;\">Support Hotline at (212) 598-6853 to have someone walk you through the LODI <\/span><span style=\"font-weight: 400;\">process. Should you be called up to the DOE Health Unit to be assessed by the DOE medical <\/span><span style=\"font-weight: 400;\">staff (this is called a 2568 Exam), the UFT has a representative at the Health O\ufb03ce who will <\/span><span style=\"font-weight: 400;\">support, advise, and accompany you through the process. Do NOT go into a 2568 without Union <\/span><span style=\"font-weight: 400;\">representation.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Navigating the LODI Claim Process:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Once your LODI claim is submitted, it will undergo a review process by your school and <\/span><span style=\"font-weight: 400;\">District administration. They will evaluate the claim, examine supporting evidence, and <\/span><span style=\"font-weight: 400;\">determine the eligibility for LODI bene\ufb01ts. They will also coordinate with the NYC O\ufb03ce of Payroll <\/span><span style=\"font-weight: 400;\">Administration (OPA) to ensure that you receive the necessary compensation and bene\ufb01ts. If <\/span><span style=\"font-weight: 400;\">you \ufb01nd that your administration denies your LODI claim and places an administrative bar on it, <\/span><span style=\"font-weight: 400;\">you have the right to grieve that \ufb01nding, so be ready to contact the UFT if this happens to <\/span><span style=\"font-weight: 400;\">you, and you would like to appeal.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Support and Compensation:<\/b><\/p>\n<p><span style=\"font-weight: 400;\">If your LODI claim is approved, you may be eligible for various bene\ufb01ts and compensation, <\/span><span style=\"font-weight: 400;\">including:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Medical Bene\ufb01ts: The DOE will cover reasonable and necessary medical expenses related to your injury, such as doctor visits, surgeries, medications, and rehabilitation services.
