{"id":6810,"date":"2021-07-28T19:35:51","date_gmt":"2021-07-28T23:35:51","guid":{"rendered":"https:\/\/solidarityuft.org\/?page_id=6810"},"modified":"2021-08-12T15:59:23","modified_gmt":"2021-08-12T19:59:23","slug":"cadet-rights","status":"publish","type":"page","link":"https:\/\/solidarityuft.org\/?page_id=6810","title":{"rendered":"Cadet Rights"},"content":{"rendered":"<p><b>Tenured Pedagogical Personnel Have \u201cCadet Rights\u201d<\/b><\/p>\n<p><\/p>\n<h2 class=\"wp-block-heading\">What are \u201cCadet Rights\u201d and why are they important?<\/h2>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">\u201cCadet Rights\u201d are named after Andre Cadet (His last name is pronounced \u201cCud Day.\u201d), a tenured teacher who had gotten himself into difficulty with DOE over a romantic relationship with a student.<\/p>\n<style>\na{color:blue;}<br \/>\n<\/style>\n<p>Decision No. 13,589 of (then) Commissioner of Education Richard Mills, and the Third Appellate Division\u2019s decision in <u>Board of Education v. Mills<\/u> (250&nbsp;A.D.2d&nbsp;122) explain what was at stake:<\/p><p><a href=\"http:\/\/www.counsel.nysed.gov\/Decisions\/volume35\/d13589\" style=\"background-color: rgb(255, 255, 255);\">www.counsel.nysed.gov\/Decisions\/volume35\/d13589<\/a><\/p>\n<p><a href=\"http:\/\/www.leagle.com\/decision\/1998372250ad2d1221345\">www.leagle.com\/decision\/1998372250ad2d1221345<\/a>&nbsp;<\/p>\n<p>According to the above two decisions, a tenured teacher could not be compelled to answer questions posed by SCI investigators.<\/p>\n<p>The Third Appellate Division\u2019s decision was relied on in <u>Condon v. Sabater<\/u> (113&nbsp;A.D.3d&nbsp;203) where the First Appellate Division found that a tenured assistant principal was not required to comply with a <em>subpoena ad testificandum<\/em> issued by SCI.<\/p>\n<p><a href=\"http:\/\/www.leagle.com\/decision\/innyco20131212271\">www.leagle.com\/decision\/innyco20131212271<\/a><\/p>\n<p><a href=\"https:\/\/en.wikipedia.org\/wiki\/Subpoena_ad_testificandum\">https:\/\/en.wikipedia.org\/wiki\/Subpoena_ad_testificandum<\/a>&nbsp;<\/p>\n<p>The lower court\u2019s decision in <u>Condon<\/u> is here:<\/p>\n<p><a href=\"https:\/\/solidarityuft.org\/wp-content\/uploads\/2021\/07\/doe-litigation-cplr-2308b-disobedience-of-subpoena-condon-v.-sabater.pdf\">doe litigation &#8212; cplr 2308(b) &#8212; disobedience of subpoena &#8212; condon v. sabater<\/a><\/p>\n<p>\u201cCadet Rights\u201d are important because they come from Education Law \u00a7 3020-a(3)(c)(i)(C) which states in&nbsp; part:<\/p>\n<p><i>The employee shall not be required to testify.<\/i><\/p>\n<p><a href=\"http:\/\/www.nysenate.gov\/legislation\/laws\/EDN\/3020-A\">www.nysenate.gov\/legislation\/laws\/EDN\/3020-A<\/a>&nbsp;<\/p>\n<p>Education Law \u00a7 3020-b(3)(c)(iii) contains an identical provision.<\/p>\n<p><a href=\"http:\/\/www.nysenate.gov\/legislation\/laws\/EDN\/3020-B\">www.nysenate.gov\/legislation\/laws\/EDN\/3020-B<\/a><\/p>\n<p>So, if tenured pedagogues can\u2019t be required to testify during their Education Law \u00a7 3020-a (or \u00a7&nbsp;3020-b) hearings, then they can\u2019t be required to testify during investigations which could possibly lead to the filing of Education Law \u00a7 3020-a (or \u00a7 3020-b) charges.<\/p>\n<p>This would appear to include the right to refuse answering questions about a tenured pedagogue\u2019s work (or alleged incidents) originating from a principal or assistant principal rather than an SCI\/OSI\/OEO investigator.<\/p>","protected":false},"excerpt":{"rendered":"<p>Tenured Pedagogical Personnel Have \u201cCadet Rights\u201d What are \u201cCadet Rights\u201d and why are they important? \u201cCadet Rights\u201d are named after Andre Cadet (His last name is pronounced \u201cCud Day.\u201d), a tenured teacher who had gotten himself into difficulty with DOE over a romantic relationship with a student.
